1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you request a quote, express an interest in our products and Services, or otherwise contact us.

Personal Information Provided by You. The personal information we collect may include the following:

  • names
  • phone numbers
  • email addresses
  • event location (address or ZIP code of the venue)
  • event type and date
  • approximate budget range
  • how you found out about us
  • contact preferences
  • any details you choose to share in comments or messages

Sensitive Information. We do not process sensitive personal information.

Payment Data. We do not collect payment card data through our website. Payments are arranged directly with you (for example, via Zelle), and any payment information is handled by the payment provider, not stored by us.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, general location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics, reporting, and advertising purposes.

Like many businesses, we also collect information through cookies and similar technologies. See Section 4 below.

The information we collect includes:

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services, such as your IP address, device information, browser type and settings, date/time stamps, pages viewed, and actions you take.
  • Device Data. Information about your computer, phone, tablet, or other device used to access the Services, such as IP address, device and application identifiers, browser type, hardware model, Internet service provider or mobile carrier, and operating system.
  • Location Data. Imprecise location information (such as city-level location derived from your IP address). We do not collect precise GPS location from your device.

Information collected from other sources

In Short: We may receive limited information about you from social media platforms and referral sources.

If you contact us through Instagram, Facebook, Messenger, or Telegram, we receive the information you share through those platforms (such as your profile name and message contents). We may also receive basic analytics and advertising performance data from Google and Meta in connection with our marketing campaigns.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To deliver and facilitate delivery of services. To prepare quotes, schedule events, and provide decoration, delivery, and installation services you request.
  • To respond to inquiries and offer support. To answer your questions and resolve issues.
  • To send administrative information. Such as booking confirmations, changes to our terms and policies, and similar information.
  • To fulfill and manage your orders. Including deposits, scheduling, rescheduling due to weather, and pickup of rental items.
  • To request feedback. To ask for reviews and feedback about our Services.
  • To send marketing and promotional communications. In accordance with your marketing preferences. You can opt out at any time (see Section 8).
  • To deliver targeted advertising. We may process your information to display advertising tailored to your interests through platforms such as Meta (Facebook/Instagram) and Google. You can opt out (see Sections 4 and 10).
  • To post testimonials. With your consent, we may post testimonials or photos of our work that may contain personal information.
  • To protect our Services. Including fraud monitoring and prevention.
  • To evaluate and improve our Services and marketing. To identify usage trends and measure the effectiveness of our campaigns.
  • To comply with our legal obligations. Including tax, accounting, and legal requirements.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We share information with service providers who help us operate our business, and in the specific situations described below. We do not sell your personal information for money.

We may share your personal information with the following categories of third parties (“service providers”) who perform services on our behalf:

  • Website hosting and forms: Tilda Publishing (website platform and form processing)
  • Customer relationship management (CRM) and workflow automation: our CRM and automation providers used to manage inquiries, bookings, and client records
  • Text messaging and notifications: Twilio (SMS) and messenger platforms (such as Telegram and Facebook Messenger) used to communicate with you
  • Analytics: Google (Google Tag Manager, Google Analytics)
  • Advertising: Meta Platforms (Facebook/Instagram advertising and the Meta Pixel), Google Ads
  • Email: our email hosting provider (GoDaddy)

We may also share your personal information in the following situations:

  • Business Transfers. In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
  • Legal Obligations. Where required to comply with applicable law, governmental requests, judicial proceedings, or to protect our rights.

“Sale” and “Sharing” under California law. We do not sell personal information in exchange for money. However, our use of advertising cookies and pixels (such as the Meta Pixel) may constitute “sharing” of personal information for cross-context behavioral advertising under the California Consumer Privacy Act (CCPA) as amended by the CPRA. You have the right to opt out of this sharing — see Section 10.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: Yes. We use cookies and similar tracking technologies to operate our website, analyze traffic, and deliver advertising.

We and our third-party providers use cookies, pixels, and similar tracking technologies (like web beacons) to collect and store information. Specifically, our website uses:

  • Essential cookies set by our website platform (Tilda) that are necessary for the site and forms to function.
  • Analytics cookies via Google Tag Manager and Google Analytics, which help us understand how visitors use our site.
  • Advertising cookies and pixels, including the Meta (Facebook) Pixel and Google advertising tags, which help us measure ad performance and show you relevant ads on other platforms.

How to refuse cookies. You can set your browser to remove or reject cookies. You can also opt out of interest-based advertising:

California residents may also opt out of “sharing” for targeted advertising as described in Section 10.

5. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

7. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account (if any) and take reasonable measures to promptly delete such data from our records. 8. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your data with us at any time, depending on your location.

Depending on your state of residence, you may have the right to (i) request access to and obtain a copy of your personal information, (ii) request correction or deletion of your personal information, (iii) opt out of the sharing of your personal information for targeted advertising, and (iv) not be discriminated against for exercising these rights.

Opting out of marketing communications. You can unsubscribe from our marketing communications at any time by replying “STOP” to text messages, clicking “unsubscribe” in emails, or contacting us at sales@bloomballoon.com. You will still receive service-related messages necessary for the administration of your booking.

9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and applications include a Do-Not-Track (“DNT”) feature or setting. No uniform technology standard for recognizing and implementing DNT signals has been finalized, and as such we do not currently respond to DNT browser signals. However, we do recognize opt-out preference signals such as the Global Privacy Control (GPC) where required by California law — see Section 10.

10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, California residents have specific rights regarding their personal information.

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, “CCPA”), provides California residents with specific rights, including the right to:

  • Know what personal information we collect, use, disclose, and share
  • Access the personal information we hold about you
  • Correct inaccurate personal information
  • Delete personal information we have collected from you, subject to certain exceptions
  • Opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising
  • Limit the use of sensitive personal information (note: we do not collect sensitive personal information)
  • Non-discrimination for exercising your privacy rights

Categories of personal information we collect. In the preceding twelve (12) months we have collected the categories of personal information described in Section 1: identifiers (name, phone, email, IP address), commercial information (event bookings and inquiries), internet activity (site usage via cookies), and general location (event venue address you provide; city-level location from IP).

“Sharing” for targeted advertising. As described in Sections 3 and 4, our use of advertising pixels (Meta Pixel, Google advertising tags) may constitute “sharing” under the CCPA. We do not sell personal information for money, and we do not knowingly sell or share the personal information of consumers under 16 years of age.

How to opt out of sharing. You may opt out of sharing for targeted advertising by:

  • Emailing us at sales@bloomballoon.com with the subject “Do Not Sell or Share My Personal Information”
  • Using a browser-based opt-out preference signal such as the Global Privacy Control (GPC)
  • Adjusting your cookie settings and the platform opt-out links in Section 4

We may need to verify your identity before processing your request. You may designate an authorized agent to make a request on your behalf.
